A sentencing hearing into the case of a former Cavan County Council Cathaoirleach who is charged with theft from Navan Mental Health took a dramatic turn today when a judge declared that it might not be appropriate for him to continue hearing the case. Sean McKiernan, Trinity Bungalow, Virginia Rd, Bailieborough is charged with theft of e172, 000 from the Meath-based charity. Mr McKiernan has pleaded guilty to certain charges.
The hearing was under way for about an hour when Judge John Martin excused himself and retired to his chambers. When he returned he said he was a member of the Charitable Services Committee which leads into the Charities Regulator and he didn’t think it would be appropriate for him to deal with the case. A further adjournment is now under way while prosecuting and defence lawyers consult.
