A chimney which had been at the centre of a neighbours’ dispute in Dunsany has now been removed, Navan District Court has been told. The case had come up in the court in April when Michael Gallagher, also known as Bob and his wife Clara of Old Road, Dunsany took a case against neighbours John Watters and Stephanie Horan alleging that the chimney was causing pollution. Solicitor John Kelleher had told the court that the Gallaghers had been raising the issue for over four years. He said the “nuisance” was interfering with their property.
The court was told that there was a large number of issues between the parties and their relationship was “fractious”. It was claimed that a gazebo in which the chimney or flue was located was “an unauthorised development”. The April court sitting was told that for four years Mr Watters and Ms Horan had been applying for permission to remove the gazebo and build an extension to the side of their house for themselves and their two young children. It was claimed in court that the Gallaghers had made various “submissions” and had “delayed” that planning permission. It was denied that the chimney had caused pollution.
When the case again came to court last Friday Judge Eirinn McKiernan was told that the chimney had now been removed. An application to the court for legal costs on behalf of the Gallaghers was refused by the judge who said that based on what she had heard in the case she was not convinced that the proceedings were ever necessary.
