A road accident that occurred on 8 th May 2021 resulted in a claim for damages coming before Navan District Court. The claim was taken by Lauren Gaffney, Ardfrail, Oldcastle who was born in July 2008. She is now 17. The claim was taken against Michaela Dubovicova, Oakleigh, Navan and insurers. A lawyer for Ms Gaffney told the court that she was a passenger in a car that was “hit by an uninsured driver”.
There were three medical reports from the injured party’s GP. There was an offer in the case of €15,000 including special damages. There were also damages of €413. The primary injury was caused by the seat belt and this injury was to the injured party’s chest. Her mother and herself were satisfied that any symptoms of that chest injury have been alleviated.
There were instances of travel anxiety included in the medical reports. The lawyer also said that he felt an award of €117,000 would be adequate in the case. There was agreement between the parties on the level of costs. Judge Eirinn McKiernan directed that damages of €17,000 be paid into court along with €413 to the solicitor of the plaintiff. The judge recorded the fact that costs had been agreed between the parties.
